Welcome to San Juan Blooms & Co. ("SJB Co.", "we", "us", or "our"). We are a local flower shop in the heart of the San Juan Mountains, Colorado. We're here to offer you exquisite floral arrangements for occasions & gatherings of all sizes.
By accessing or using our services, you ("Client", "you", or "your") agree to be bound by these Terms of Service. Please take a moment to read them carefully.
When you visit our site or purchase from us, you're engaging in our "Service." This means you agree to the following terms and conditions ("Terms of Service," "Terms"), including any additional terms and policies referenced here or available by hyperlink. These Terms apply to everyone who uses our site, including browsers, customers, and contributors.
Please read these Terms of Service thoroughly before accessing or using our website. By accessing or using any part of our site, you agree to these Terms. If you don't agree with all the terms and conditions, you may not access the website or use any of our Services. If these Terms are considered an offer, acceptance is specifically limited to these Terms of Service.
1. General Terms Applicable to All Services
1.1 Service Agreement: These Terms of Service create a legally binding agreement between you and San Juan Blooms & Co. regarding your use of our services.
1.2 Changes to Terms: We may update or modify these Terms at any time without prior notice. Your continued use of our services after any changes means you accept the new Terms.
1.3 Privacy Policy: Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review it here.
1.4 Communications: By using our services, you agree to receive electronic communications from us, including emails, text messages, or phone calls related to your orders or services.
2. Flower Shop Services (Retail & Subscriptions)
2.1 Product Availability: All floral arrangements and products depend on availability. Since flowers are seasonal, specific blooms, colors, or vase types may vary. We reserve the right to substitute flowers or materials of equal or greater value while keeping the overall aesthetic of your arrangement.
2.2 Pricing & Payment:
All prices are listed in USD and can change without notice.
Payment for retail orders is due in full at the time of purchase.
For flower subscriptions, payment will be processed according to your chosen frequency (e.g., monthly, bi-weekly) and subscription length. Your subscription will automatically renew unless you cancel it according to our cancellation policy (see 2.5).
2.3 Delivery:
We offer delivery within Telluride, Ridgway, Ouray, and surrounding areas.
Delivery fees apply and will be communicated when you place your order.
It's your responsibility to provide accurate and complete delivery information. San Juan Blooms & Co. is not responsible for delays or non-delivery due to incorrect addresses or if the recipient isn't available.
For unattended deliveries, flowers will be left in a safe, shaded location if possible. San Juan Blooms & Co. is not responsible for damage or theft after delivery.
2.4 Quality & Freshness: We guarantee the freshness and quality of our flowers upon delivery. Please inspect your order immediately upon receipt. Any issues or concerns must be reported to us within 24 hours of delivery.
2.5 Cancellations & Refunds (Retail & Subscriptions):
Retail Orders: To receive a full refund, cancellations for standard retail orders must be made at least 24 hours before the scheduled delivery or pick-up time. Cancellations made less than 24 hours prior may be subject to a 50% charge.
Flower Subscriptions: You can cancel your subscription at any time. Cancellations must be submitted at least 7 days before your next scheduled delivery to avoid being charged for that delivery. Pre-paid subscription plans are non-refundable once the first delivery has been made, but you may pause or transfer deliveries (see 2.6).
Refunds: Approved refunds will be processed within 7 days to the original payment method.
2.6 Pausing or Transferring Subscriptions: Subscribers can request to pause deliveries or transfer their remaining subscription deliveries to another recipient by contacting us with at least 7 days' notice before the next scheduled delivery.
3. Event & Floral Design Services
3.1 Consultation & Proposal: Our event design services begin with a consultation to discuss your specific desires, event details, and budget. After this, we'll provide a detailed proposal outlining our design concept, estimated costs, and terms unique to your event.
3.2 Booking & Payment Schedule: To secure our event design services, we require a non-refundable retainer fee (25% of the estimated total) and a signed contract. The remaining final balance is due 30 days before the event date. Failing to make payments by the due dates may lead to delays or cancellation of services.
3.3 Changes & Revisions: Any changes to the event scope, floral selections, or design elements must be submitted in writing. Significant changes may incur additional charges and depend on our ability to accommodate them, especially closer to the event date.
3.4 Event Day Execution: We will execute the agreed-upon design on your event day, ensuring timely delivery, setup, and installation of all floral elements. We are not responsible for issues caused by circumstances beyond our control, such as venue restrictions, access limitations not communicated in advance, or severe weather.
3.5 Cancellation Policy (Event Design): All retainer fees for event design services are non-refundable. If you cancel after the final payment due date, you'll forfeit the full payment. For cancellations made before the final payment due date, you'll be responsible for any costs San Juan Blooms & Co. incurred up to that point, including design time, ordered materials, and non-refundable vendor deposits. If an event is postponed, we'll do our best to transfer services to the new date, subject to our availability and any additional costs.
3.6 Rental Items: Any vases, arbors, props, or other items rented from San Juan Blooms & Co. for your event remain our property. Rental items must be returned in their original condition by the agreed-upon time and method. You are responsible for any damage, loss, or excessive cleaning required for rented items and will be billed accordingly.
4. Intellectual Property
All designs, concepts, photographs, and content created by San Juan Blooms & Co. are our exclusive intellectual property. Unauthorized use, reproduction, or distribution is prohibited. We reserve the right to photograph our work and use it for marketing and portfolio purposes.
5. Limitation of Liability
San Juan Blooms & Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use or alteration of your transmissions or content.
6. Indemnification
You agree to defend, indemnify, and hold harmless San Juan Blooms & Co., its employees, agents, and affiliates, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account and password; or (b) a breach of these Terms.
7. Governing Law & Dispute Resolution
These Terms will be governed and interpreted in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or our services will be resolved exclusively in the state or federal courts located in Ouray County, Colorado.
